| Why is a Crew Contract so important?Imagine that this could happen to you:
Those are only 3 examples of how a crew contract can protect you. We feel that crew contracts are very important because they protect you from the legal tangles that can get really nasty after your holiday ends.Here are our conditions:§1 The planned sailing trip is only for the purpose of sharing a holiday. It does not represent an enterprise whose aim is to achieve a profit. The Rhön-Yachting-Club is not a commercial enterprise for profit earning purposes, but is a private interest group. §2 The recepient party of this contract (hereafter designated as "Crew Member") confirms with his signature, that he/she has obtained medical and/or accident insurance for the area where the trip is planned to. The Crew Member shall undertake this trip at his own risk. The Crew Member thus excludes any and all claims for compensation for any and all injuries, disability or death resulting from this trip. Claims imposed by third parties for the death, disability or injury are hereby invalid. §3 The Crew Member is hereby obligated to follow all instruction issued by the ship's master, as long as these are not unlawful. Damages resulting from the direct disobedience of a crew member represent gross negligence, and the Crew Member shall be responsible for any and all consequences resulting from direct disobedience. §4 Crew Members are solely responsible for their own private property. Should their property be damaged within the course of the trip, they shall not be able to issue damage claims against other trip participants (even in cases of gross negligence). §5 The Crew Member hereby confirms that he/she is able to swim at least 15 minutes without the aid of any devices. Should this not be the case, the Crew Member shall be soley responsible for his/her own safety, and shall be required to wear personal floatation devices or life belts, without being prompted or reminded by the ship's master. §6 All Crew Members hereby agreed to equally share the costs incurred for
charter insurance policies, which protect the interests of a charter boating
trip, including: §7 Should a ship accident occur, incurred costs which are not covered by insurance, shall be shared equally by the trip participants, such as lodging, transport, salvage and administration costs. §8 Should the Crew Member pose a danger for themselves, the Crew, or the safety of the ship, so is the ship's master entitled to order the Crew Member to disembark. If this was due to health or safety reasons to the Crew Member, the Crew or the vessel, the Crew Member shall not be entitled to compensation for damages or costs incurred. §9 If it is not possible for the Crew Member to participate on the trip, a the amount stipulated in the Crew Contract shall not be refunded nor declared invalid. In exception to this agreement, the Crew Member may substitute another person to serve as Replacement Crew Member. The Replacement Crew Member shall only be accepted, if the other trip participants verbally or writtenly agree to accept the replacement person. Contractually stipulated monetary amounts for trip costs are not adjustable in the case that fewer participants participate in a trip than planned for. §10 German Sea Law shall apply, irregardless of the country the trip takes place in. |
